Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a legal agreement between you and PubliTest Inc., a corporation registered in Québec, Canada, operating under the trade name “AdsEasy” (the “Service,” “we,” “our,” or “us”). Contact: [email protected].

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service

AdsEasy is a platform that helps small businesses create and manage advertising campaigns on Facebook and Instagram using AI-assisted tools. The Service is a tool; we do not guarantee any specific advertising outcomes, including impressions, clicks, leads, or revenue.

3. Account

To use the Service you must create an account with accurate, complete information. You are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 18 years old and have the legal authority to enter into these Terms on your own behalf or on behalf of the business you represent.

4. Meta Connection

The Service requires you to connect a Meta Business account. By connecting your account, you authorize AdsEasy to create and manage advertising campaigns on your behalf. You represent that you have the authority to grant this access and that your use of Meta’s advertising platform complies with Meta’s own terms and advertising policies.

Meta is not a party to these Terms. Your use of Meta’s platform is governed by your separate agreement with Meta, including the Meta Advertising Standards. Violation of Meta’s policies may result in your ads being disapproved or your Meta account being restricted, and is grounds for us to suspend your AdsEasy account.

5. Subscription and Payment

AdsEasy offers a Free plan and a paid Pro plan. Pricing is shown on the upgrade page and may change with at least 30 days’ notice. By completing checkout you agree to be charged the then-current subscription price on a recurring basis until you cancel.

No refunds. Subscription fees are non-refundable. On cancellation, you retain Pro access until the end of your current billing period, after which your account reverts to Free. We do not pro-rate refunds for unused time.

Immediate performance and waiver of withdrawal right. The subscription service activates immediately when your payment is confirmed. By completing checkout and checking the confirmation box on the upgrade page, you expressly acknowledge that performance begins immediately and you waive any statutory right of withdrawal (cooling-off period) that would otherwise apply.

6. Ad Spend

AdsEasy does not charge you for your Meta ad spend. Ad spend is billed by Meta directly through your connected ad account. You are solely responsible for managing your ad budget and any charges incurred through Meta’s platform.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Create misleading, deceptive, or fraudulent advertising content
• Violate Meta’s Advertising Standards or Community Standards
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service without our written permission
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with third parties

8. AI-Generated Content

The Service uses artificial intelligence to generate ad copy, targeting suggestions, and creative recommendations. AI-generated content may occasionally be inaccurate or unsuitable. You are responsible for reviewing and approving all content before it is published. AdsEasy is not liable for any consequences arising from AI-generated content you choose to publish.

9. Cancellation and Termination

You may cancel your subscription at any time from the upgrade page inside the app. On cancellation you retain Pro features until the end of your current billing period; after that, your account reverts to Free. We may suspend or terminate your account if you violate these Terms, with or without notice. On termination, your right to use the Service ceases immediately and your Meta access tokens and related data are deleted in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific advertising results or outcomes from using the Service.

11. Limitation of Liability

To the maximum extent permitted by law, AdsEasy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim. For clarity, Meta ad spend is paid by you directly to Meta and is excluded from any liability cap under these Terms.

12. Intellectual Property

Our IP. The Service, including its software, design, branding, and content (excluding your inputs and Meta Platform Data), is owned by AdsEasy and is protected by copyright, trademark, and other laws. These Terms do not grant you any right, title, or interest in the Service other than a limited, revocable, non-transferable license to use the Service as intended.

Your content. You retain all rights in the business information, campaign inputs, and creative assets you upload or enter into the Service. By using the Service, you grant AdsEasy a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your content solely as required to operate the Service on your behalf, including transmitting your content to the service providers and advertising platform partners needed to deliver the features you use (for example, to generate ad copy and to publish the ads you approve).

AI-generated outputs. Subject to your compliance with these Terms, you own the ad copy, creative recommendations, and other outputs generated for your campaigns. AI-generated output is not guaranteed to be unique — similar inputs may produce similar outputs for different users.

13. Governing Law and Disputes

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the courts of Québec, Canada, unless a mandatory consumer-protection law in your jurisdiction grants you the right to bring an action elsewhere. Nothing in these Terms limits your statutory consumer-protection rights in your country of residence.

14. Notices

We deliver notices to you by email to the address associated with your account, by a banner or message inside the Service, or by updating the relevant page on our website. You consent to receive electronic communications from us, and you agree that electronic notices satisfy any legal requirement that notices be in writing. 15. Changes to Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. For material changes, we will also notify you by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
